Terms and Conditions of Rental

Responsibility for Vehicle Damage: As the renter, I acknowledge and accept that I am responsible for damage to the rental vehicle during the rental period, whether caused by me, a passenger, or a third party, up to the deductible of the protection level in effect for this rental (or in full if no protection applies or if the protection is void under the Renter Obligations clause). I understand that the rental company reserves the right to charge me for any damages, including the cost of repairs, loss of use, and administrative fees.

Security Deposit: I understand that a security deposit is required to secure the rental vehicle, and that the deposit hold is released after the vehicle is returned in the same conditions as picked up; the refund may take up to 10 business days to appear, depending on your bank. I acknowledge that any damage, additional charges, or violations of the rental agreement may be deducted from the security deposit.

Smoking and Pet policy: I acknowledge and accept that smoking in the rental vehicle is strictly prohibited. I understand that a smoke fee of up to $350 will be applied if any evidence of smoking is found in the vehicle, additionally, I understand that the same applies for carrying pets inside the vehicle and leaving evidence of it like, but not limited to, smell, fur and fecal matter, and that these fees apply as stated in this agreement.

Late Return Fee: I understand that if I return the rental vehicle later than the agreed-upon return date and time, a grace period of 59 minutes applies. Beyond that, if Late Check-out was not purchased, I will be charged a late return fee of $99.00 plus one full day at the applicable daily rate. I acknowledge that this fee will be applied for every 24-hour period that the vehicle is not returned after the agreed-upon date and time.

State and Toll Road Restrictions: I understand and accept that the rental vehicle is not allowed to leave the State of Florida, and that an out-of-state fee of $500 may be applied if the vehicle is taken out of the state. Additionally, I understand that toll road usage will incur additional charges, and I will be charged accordingly for any unauthorized usage of toll roads.

Fuel Policy: I understand and accept that I must refuel the rental vehicle before returning it, to the same fuel level as when I received it. I acknowledge that if the vehicle is returned with less fuel than at pick-up, a refueling service charge of $9.99 per gallon will be applied to the difference. I understand that this rate is higher than the local retail pump price and reflects the cost of refueling the vehicle. To avoid this charge I may refuel the vehicle before returning it, or purchase the Prepaid Fuel option at the time of rental.

Excess mileage: I understand that AZ Car Rental reservations include unlimited mileage unless otherwise stated in this agreement; if a mileage limitation applies to my contract and that AZ reserves the right to charge a fee of up to $0.35 for each exceeding mile on the contract.

By signing below, I acknowledge that I have read and understood the terms and conditions of this car rental agreement, and agree to comply with them fully.

By renting a vehicle from AZ Car Rental, the renter agrees to accept all the Terms and Conditions and Privacy Policy applicable to this Rental Agreement without exception or reservation. Collection of Information and Texting & Calling Terms.

By signing below, Renter agrees to Owner's collection of information about Renter’s use of Vehicle and Texting & Calling terms, as described in the Terms and Conditions. Please refer to the paragraphs with the headings "Text & Call" and "Owner's Collection and Use of Vehicle Data: Renter's Use of Vehicle Navigation and Infotainment Systems and Vehicle Manufacturer Apps."

Florida State Law.

By renting a vehicle with AZ Car Rental, the renter agrees to comply with Florida State Law - 627.7263 Rental and leasing driver’s insurance to be primary; exception. (1) The valid and collectible liability insurance or personal injury protection insurance providing coverage for the lessor of a motor vehicle for rent or lease is primary unless otherwise stated in at least 10-point type on the face of the rental or lease agreement. Such insurance is primary for the limits of liability and personal injury protection coverage as required by ss. 324.021(7) and 627.736. (2) If the lessee’s coverage is to be primary, the rental or lease agreement must contain the following language, in at least 10-point type: “The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7)."

Damage Waiver Notice.

Renter acknowledges receipt of oral disclosure that Damage Waiver (which may also be known as Loss Damage Waiver or Collision Damage Waiver) may be duplicative of coverage maintained under their own policy of motor vehicle insurance. Purchasing a damage waiver is voluntary and may be declined if you have similar coverage from another third-party insurance company. Our team will conduct a thorough review of your existing coverage to determine its suitability with a security deposit from $500 up to $3000.

Warning.

Operating, servicing, and maintaining a passenger or off-road vehicle may expose the renter to chemicals, including engine exhaust, carbon monoxide, phthalates, and lead, which are known to the State of Florida to cause cancer and birth defects or other reproductive harm. To minimize exposure, the renter should avoid breathing exhaust, not idle the engine except as necessary, service the vehicle in a well-ventilated area, and wear gloves or wash their hands frequently when servicing the vehicle.

Governing Law, Venue and Severability. This agreement is governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any action, claim or proceeding arising out of or relating to this agreement shall be brought exclusively in the state or federal courts located in the State of Florida, and the renter consents to that jurisdiction. If any provision of this agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement. This agreement, together with the reservation and any document expressly referenced in it, constitutes the entire agreement between the parties for this rental and supersedes any prior or contemporaneous statement, quote or communication, whether verbal, by message or by email. No modification is valid unless made in writing and agreed by AZ CAR RENTAL.

Personal Property. AZ CAR RENTAL is not responsible for any personal item left, lost, damaged or stolen in or from the vehicle at any time, including after the vehicle has been returned. The inspection performed at return is technical and does not include a search for personal belongings. The renter is responsible for removing all personal property before returning the vehicle.

Processing Fee Policy.

When making payments with debit or credit cards, customers may incur a processing fee of up to 4% of the transaction amount, where applicable. Any such fee is always informed at checkout before payment.Parking Facilities.

As a renter of a vehicle from AZ Car Rental, you are responsible for any fees associated with parking your rental car, including those for parking facilities, airport parking facilities, and other charges required to fulfill your reservation outside of AZ Car Rental's office locations. The renter is responsible for all such parking charges incurred during the rental period.Fuel Policy.

Upon receiving your rental car, it will have a predetermined fuel level. If you return the car with the same amount of fuel, you will not be charged any extra fees. However, if you choose not to refuel the car to the same level, we will charge a refueling service fee of $15.00 plus $9.99 per gallon for the fuel required to restore the original level. This per-gallon rate is higher than the local retail pump price and reflects the cost of refueling the vehicle. To avoid this charge, refuel the vehicle before returning it or purchase the Prepaid Fuel option at the time of rental. Please also note that we cannot guarantee a full tank of gas when you pick up the car.

Tolls Policy.

When renting a vehicle with AZ Car Rental, the renter agrees to our toll policy, which includes a daily fee of $11.99 per day for unlimited toll usage anywhere in the State of Florida, capped at $99.00 per rental. If this option is not selected or is declined by the renter, AZ Car Rental reserves the right to charge $10.99 per toll transaction as an administrative fee, in addition to the toll amount. The use of personal toll devices or the removal of AZ Car Rental toll devices is strictly prohibited. Any violation of this policy will result in a $100 penalty. By renting a vehicle from AZ Car Rental, you acknowledge and agree to comply with this toll policy.

After-Hours Returns.

To return your rental car after hours, please park the car, leave the keys inside the vehicle, and send a photo of the parked car and of the keys to our team on WhatsApp at +1 (727) 543-1097. The return is only considered complete once we receive that photo. Please remember to take all of your personal belongings with you before leaving. Any parking cost at the return location is the responsibility of the renter. Cancellation Policy.

If your reservation was not prepaid, there will be no fee for cancellation.

However, if the reservation was paid in advance, the following rules will apply: Cancellations made at least 72 hours before the scheduled pickup time are FREE: you receive a full refund of the booking amount. For cancellations less than 72 hours before the scheduled pickup time, a cancellation fee of USD $150.00 applies, deducted from the refund.

If you return the vehicle before the original return date, there will be no refund for the unused portion of the payment.

No-show Policy.

In the event that you fail to collect your rental car within 1 hour of the scheduled pick-up time, you will be considered a "no-show" and your reservation will be canceled without a refund. Please note that a "no-show" includes situations where you are unable to take the car due to reasons such as arriving late, not having the correct documentation, being ineligible for the rental due to age or license type, or the primary driver not having a credit card with sufficient credit to cover the deposit.

CDW Standard Protection.

Our CDW (Standard Collision Damage Waiver) Standard Protection is INCLUDED by default in every AZ Car Rental reservation, at no additional cost. This plan covers collision damage to the rented vehicle above the deductible amount. The CDW plan has a deductible of $3000, which means that you will be responsible for paying this amount to AZ in case of any damages or accidents. By renting with the included CDW plan, you acknowledge and agree that you have read and understand the terms and conditions of the plan, including the $3000 deductible. You also understand that the CDW plan does not cover any damages or injuries caused to third parties. Additionally, customers will be required to provide a minimum security deposit of $500.00. Also, in case of accident, involving renters vehicle rented or third party vehicle, renters must pay the deductible amount agreed upon the reservation time. If renter cannot comply in full with the deductible amount or AZ CAR RENTAL cannot charge the deductible amount from renters security deposit or credit/debit card, or renters refuses to comply with the deductible/CDW terms and conditions, the CDW will be considered voided and renter will be liable for the entire damages amount or total charges involved in the accident.

CDW Prime Protection (optional paid upgrade). For an additional daily fee, the renter may upgrade to CDW Prime Protection, which reduces the deductible on the rented vehicle from $3,000 to $1,000. The upgrade must be selected at the time of booking or at pick-up and applies for the entire rental period. Customers will still be required to provide a minimum security deposit of $500.00. The deductible and CDW-void conditions described above apply equally in this case. By selecting CDW Prime Protection, the renter acknowledges and agrees that they remain responsible for up to $1,000 in case of any damage to the rented vehicle.

Total Protection — Zero Deductible (optional paid upgrade). For an additional daily fee, the renter may upgrade to Total Protection, which reduces the deductible on the rented vehicle to $0. The upgrade must be selected at the time of booking or at pick-up and applies for the entire rental period. Customers will still be required to provide a minimum security deposit of $500.00. The deductible and CDW-void conditions described above apply equally in this case.

Total Protection applies to damage to the rented vehicle only. It does not extend, increase or replace the third-party liability coverage carried on the vehicle, which is provided at the minimum limits required by Florida law and applies whether or not this upgrade is purchased. Any liability exceeding those statutory minimum limits remains the responsibility of the renter.

Renter Obligations — Information, Lawful Use and Cooperation. The protections described in this section — including the included CDW, CDW Prime Protection and Total Protection — are conditional. As a condition of any protection, the renter must: (a) provide complete, accurate and current information, including a valid driver’s license, identification, contact details and the identity of every additional driver, and promptly notify AZ CAR RENTAL of any change; (b) use the vehicle lawfully at all times, and not permit any use prohibited by this agreement or by law, including operation by an unauthorized or unlicensed driver, or operation while under the influence of alcohol or any controlled substance; (c) in the event of any accident, damage, theft or loss, notify AZ CAR RENTAL immediately, file a report with the appropriate police authority, and provide AZ CAR RENTAL with every document requested; and (d) cooperate fully and in good faith with AZ CAR RENTAL and with any insurer, adjuster or authority in the investigation and resolution of any claim, and not admit liability on behalf of AZ CAR RENTAL.

If the renter provides false or incomplete information, uses the vehicle unlawfully or in breach of this agreement, or fails to report or to cooperate as required above, the protections described in this section are void, and the renter is liable for the full amount of all damages, losses and charges arising from the rental, without application of any deductible limit.

Own Insurance Coverage (optional)

Instead of the included CDW, the customer may choose to use their own insurance coverage, providing proof of a current and valid policy. The customer must present a current and valid policy, which will be verified by our staff through a phone call to the insurance provider. If the customer chooses to use their own insurance coverage, they must agree to comply with all AZ CAR RENTAL terms and conditions. Additionally, customers will be required to provide a security deposit of $500 if their own insurance policy is based in the United States or up to a maximum of $2000 if their coverage is from out of the United States. This deposit will be held until the end of the rental period and will be released, less any deductions for damages, once the vehicle has been returned and inspected. Please note that if the customer fails to provide proof of insurance coverage or if the coverage is deemed inadequate, they will be required to purchase our Collision Damage Waiver Standard Protection plan. This plan offers a deductible of $3000, which the customer will be required to pay in case of any damages to the rental vehicle. We highly recommend that customers carefully review their insurance coverage before renting a vehicle from us. It is the customer's responsibility to ensure that they have adequate insurance coverage for the rental period.  The deductible and CDW-void conditions described above apply equally in this case.

Credit Card Coverage.

As a condition of renting a vehicle from AZ Car Rental, the customer is required to provide proof of insurance coverage. If the coverage is provided by a credit card, the renter will need to have a current and valid policy, which will be verified by our staff through a phone call to their credit card provider, along with a statement proving that the rental was paid for using the same credit card. Additionally, customers will be required to provide a security deposit of $3000. This deposit will be held until the end of the rental period and will be released, less any deductions for damages, once the vehicle has been returned and inspected. Please note that if the customer fails to provide proof of insurance coverage or if the coverage is deemed inadequate, they will be required to purchase our Collision Damage Waiver Standard Protection plan. This plan offers a deductible of $3000, which the customer will be required to pay in case of any damages to the rental vehicle.  The deductible and CDW-void conditions described above apply equally in this case.
